The Supreme Court of India has observed that when a bench has clearly indicated its view and directed counsel to cease further submissions, that direction must be respected. The Court emphasised that continuing to press arguments after such indication serves no useful purpose and undermines the decorum of proceedings.
In a matter involving the Uttarakhand State Election Commission, the bench of Justices Vikram Nath and Sandeep Mehta noted that despite being informed six times that the case did not warrant interference, the counsel persisted in making submissions.
The Court added that lawyers must balance their duty to their client with their duty to the court. It stated that the orderly functioning of the judicial process is best ensured when the bench and the bar “move in symphony” and show mutual respect.
