The Gujarat High Court has observed that when a married daughter returns to her parental home complaining of harassment or abuse by her husband, the father is expected to provide protection and emotional support. A lack of such support, the Court noted, could push a distressed woman toward extreme steps, including suicide.


The observation came while the Court was examining a case related to a woman’s death, where allegations pointed to continued mental distress caused by her marital situation. The Court highlighted that parental responsibility does not end with a daughter’s marriage, particularly when she seeks refuge after facing cruelty in her matrimonial home.


Emphasizing the importance of family backing during vulnerable situations, the Court remarked that indifference or refusal to help may aggravate a woman’s emotional turmoil. Such circumstances, when combined with ongoing harassment, can create conditions that may ultimately lead to tragic consequences.
