  • Live-In Couple Entitled To Protection From Parental Threats, Adults Free To Choose Partners: Delhi High Court

The Delhi High Court held that two consenting adults in a live-in relationship are entitled to police protection if they face threats from family members, reiterating that adults are free to choose their partners and live together without interference.

Justice Saurabh Banerjee observed that the right to choose a partner and live with them flows from Articles 19 and 21 of the Constitution, which protect personal liberty and freedom.

Key Observations by the Court
A live-in relationship between consenting adults is not illegal and is akin to marriage in terms of personal choice.

Parents, relatives, or any other person cannot interfere in the couple’s decision to live together.

The court directed the police to provide protection if the couple faces threats or harassment.

Facts of the Case
The couple approached the court alleging threats from the woman’s father due to their live-in relationship.
They had also executed a live-in relationship agreement acknowledging their voluntary relationship.

Court’s Direction
The High Court allowed the petition and said the couple can approach the concerned SHO or beat constable for protection whenever required, and the police must provide assistance according to law.
